@Ward-Ron First of all, we are not Magix staff, so you need to contact support directly for a definitive answer.

You can find the license here: https://producerplanet.com/pdf/royalty-free-commercial-license-en.pdf

Generally, there is always the problem that you risk a copyright claim or strike on social platforms if you use loop based music, because somebody might have already registered music made with the same loops. The can lead to videos or live streams of the game getting blocked or worse.

As @SP. advised, the only way you can check whether this is possible is to contact infoservice@magix.net and ask for a definitive answer. We are all fellow-users, not Magix employees so are not able to offer any advice other than that, sorry.

I looked, very quickly, at the document that @SP. linked and the following statement seems very pertinent to you:

The provider grants the customer a nonexclusive, nontransferable right unrestricted in terms of location or time to the private and noncommercial use of the content

Hi

. . . . I have Royalty Free Licenses for the Tracks I've made . . . .

A 'Royalty free' licence, is one that you do not have to pay a royalty fee to use, this is the standard licence you get with the program, it does not allow you to sell creations made with this type of licence.

In order to sell your creations you need to have purchased to Commercial licences for all the Sound loops you have used.

There is no differentiation that indicates a Soundpool is commercially licenced and others are not - they are the same soundpools, you must retain copies of the licences for those you purchase.

You, or anyone else using Soundpools, only have copyright of the entire work that has been created.

Copyright of Soundpool loops is retained by Magix - you and other users of those loops only have licences to use them within the terms and conditions of the appropriate licences.

Anyone claiming that you have copied a piece of their work, ie have used the same loop or loops cannot claim copyright on that alone.

I think that depends on the version of Music Maker. As far as I know, the Soundpools included in Music Maker Ultimate come with a commercial license.

HI Sp.

. . . . Music Maker Ultimate come with a commercial license . . . .

That is correct for versions upto Music Maker 2024 with subscription. with Music Maker 2025 it becomes unclear, and Music Maker 2026 the wording changes to 'Access to all':-

Apologises, I have the "Commercial (Royalty-Free)" Licence on the Soundpools that I used for the Track, as referred to on Producer Planet

What I am also assuming according to the claiming part, is this applies if Someone else was to rip the Track I've made out of the Game Dev's Game, then claim it as their own, or other similar scenarios that would cause copyright issues between me and the Game Dev, vs that third entity. Is that correct or have I misunderstood ?

That is correct, the similar scnarios would also iclude claims from anyone who has created a work using any of the sounpool loops you have used and posted on Youtube, Spotify or any other music sites.

Whoever owns the Copyright, you own the copyright of the work you created, though you could assign this to the Game Dev, will have to deal with the claims.

Keep good documentation of the Soundpools and loops used, and the sale to the Game Dev and any thing else you may feel relevant, in particular the Magix Commercial licensing T & C, both in hard copy and link to the Magix T & C of use for the Commercial Soundpool loops.
