Are included Libraries Commercial Royalty Free?

Antony-Donlan wrote on 8/5/2025, 8:08 AM

I have purchased Acid Studio, thinking of upgrading to Pro, for added features and 13GB acid library.
Before I commit I wish to know if the library that comes Acid Studio standard and pro are commercial royalty free or not?

I would be grateful if this could be clarified with a link to specific info from Magix on this point as I don't want to have legal issues and claims on projects I may use library on in the future.

@Antony-Donlan I'm pretty sure it's stated in the EULA. Please look there.

My guess is, that Audio Studio doesn't allow commercial usage but Acid Pro will probably allow commercial usage of the included loops.

I don't want to have legal issues and claims on projects I may use library on in the future.

By the way, you cannot prevent claims or legal trouble if you use loops. A lot of other people before you created songs with the same loops and registered them in Content ID databases (even if it's technically not allowed, but nobody cares). These will automatically flag your music with copyright claims. The only way is to fight each claim manually or to manually modify the loops so that they become basically unrecognizable.

As suggested I looked at https://www.magix.com/gb/eula/professional/

1.1 "MAGIX Product" refers to the product licensed under this agreement, consisting of Software and, if applicable, additional Contents

1.3. Within this agreement, "Contents" refers to those Contents which are included in a MAGIX Product in addition to the Software, such as music files, video files and photo files, as well as other sounds and templates that contain such files.

1.7 "Commercial Use", for the purpose of this agreement, constitutes any commercial use and any use of the Software or Contents for the direct or indirect purpose of financial benefit (e.g. by means of sale, licensing, advertising, etc.).

5. Using the Software and Contents for commercial purposes 5.1 Software The Software may be used for commercial purposes subject to the restrictions in clause 6. 5.2 Contents a) The Contents may be used for commercial purposes subject to the restrictions in clause 6 if they are used to create your own work results. This also applies to music, video or photo data as well as the corresponding templates acquired through or by means of MAGIX Products. b) Exploitation of Contents outside the scope of personally created work, i.e. separate from the work results achieved with the Software, is prohibited in all cases. In particular, the photos contained in the templates may not be extracted and used separately. This applies to both Commercial and non-commercial Uses.

6.2 The MAGIX Product as well as the written documentation cannot be commercially rented out or commercially lent in any other form to a third party in exchange for payment. This also applies to lending of the Software in a pre-installed form on a Computer that is commercially offered to third parties in exchange for payment.

Interesting if someone is renting out a recording studio eh?
In the main one could argue that this covers the sharing of the program and content beyond a private user (although it's called Acid Pro) beyond the one who purchased the MAGIX product, and also deconstruction and cracking of software (I get the de-compiling bit)

Using the Software and more specifically the Contents for commercial purposes as stated in clause 5.1 where it states: Software The Software may be used for commercial purposes subject to the restrictions in clause 6, I do not see the licensing of the content specifically explained in clause 6.

Basis question to Magix regards the status of whether the library content is commercial royalty free or not?

Really sorry if this seems pedantic, but clarity is required by right of law in disclosure of terms in balanced contracts. I would like to upgrade, but need to know the standing of the aforementioned.

Thanks all

@Antony-Donlan If you run the installer for the software, you will usually see the EULA and need to accept it. Maybe install the Acid Pro trial version and check what is written in that EULA. At least in the past, consumer versions of Magix software didn't allow commercial usage of the included contents.

For example, you couldn't use the graphic and audio files included in Movie Studio or Samplitude Music Studio commercially. But it was possible to use them commercially if you bought Video Pro X or Samplitude Pro X. This is why I speculated, that the content in Acid Studio version may only be non-commercial while in Acid Pro it's probably commercial. But I haven't checked the EULA myself.
