Welcome to the Magix user to user forums.

Unless you specifically selected and bought one of the Commercial licences for a specific soundpool, all your licences will be non-commercial.

This page details the differences between the different licences. As far as I am aware, there is not method of Upgrading a non-commercial to a commercial licence, other than paying full price for the latter.

Thank you for the response, I have combed through these pages and I can never find the unlimited license to even purchase. I originally got the software through Humble bundle, I have the EDM Music Maker edition and the Premium 2021 with Pools Unlimited, I am a live streamer and want to make and use my own music on my streams to avoid my videos being taken down due to copyright. Is there a license that covers the Music Maker software in its entirety?

@Ryezing No, there is no license that covers the software in its entirety. But you don't need many soundpools to make varied music. Maybe two or three of a style you like should be enough. Even if you have bought a commercial license for a soundpool it doesn't save you from some bogus takedowns initiated by bad imposters that claim that they have the the copyright of these sound loops. The license just helps you to prove after the takedown that this was a false claim and that your video needs to be reinstated. Therefore it is important to add your own little spin to the music like selfmade melodic lines.

The only way to be nearly 100% safe is to make your own music from scratch or use widely known royality free music that everybody uses.

Okay I follow now, I think... So I have made just non lyrical music using different beats and soundpools to use during my live streams. I use a stream deck to play or stop the tune at any moment. While using a mixture of sounds. Unless I plan to sell the actual music I need the Com License correct. If I wanted to make a beat and play said beat, I should not be in violation of the DMCA copyright violations per twitch guidelines the tune only exists on my system.

 

My Intentions here are not to sell the music, but I can gain traffic and earn revenue on my stream where the music will be played for 30s-1 minute+ during loading screens.

I love the software and the loops so I am making sure I don't violate the terms of the software use.

@Ryezing In my opinion this falls directly under the category of commercial use where a license is needed.

I don't know what algorithms Twitch uses to take down live streams. Magix will not take your video but some other entities could possibly do it if an AI finds some similiarities with other commercial tracks.

This comes under the general definition of 'Public broadcasting' for which you do need the commercial licences for every Magix Soundpool you have used a loop from.

If you are using 'Royalty free' loops do be aware that they are still Copyrighted to the creator and many so called Royalty free loops have to be paid for, ie you get a licence to use them according to the Terms and Conditions of the licence without further payments dependant on audience size, number of plays etc.

To expand on this - you will likely get Copyright or Plagiarism claims for the music you create even with commercially licenced Soundpools or Royalty free music - this is inevitable when using pre-made loops, these claims are generally not enforceable. There are also entities on the Internet who scrape music sites etc claiming Copyright or Plagiarism and demanding payment for the right to use them - fortunately they are few and should be ignored.
